abends, wenn wir von der Arbeit kommen noch die Kinder von der Tagesmutter

erwiesenermaßen weniger verdient als Frau und dann...

DIE AUTORIN:

Utl.: Kündigung als Mittel gegen sexuelle Übergriffe zu wenig!
≥Das sind klare sexuelle Übergriffe gegenüber den Schülerinnen", so die
Vorsitzende der AKS (Aktion kritischer SchülerInnen), Kim Kadlec, zu den
Ereignissen an der HAK/HAS Oberwart, wo ein Lehrer eine Videokamera am WC
der Schülerinnen installiert hatte. Kadlec fordert weitergehende Maßnahmen
als nur die Kündigung des betreffenden Lehrers: ≥Dieses Thema darf nicht
mehr länger tot geschwiegen werden. Besonders in der Schule nicht."
Kadlec befürchtet, dass nun versucht werde, das Thema möglichst schnell
unter den Tisch zu kehren: ≥Wenn nicht endlich offen über diese
Vorkommnisse diskutiert wird, wird sich nie etwas ändern und wir werden
noch viele Fälle wie in Oberwart erleben". Hier spiele auch hinein, dass
Mädchen und junge Frauen in der Schule kaum die Möglichkeit haben, das
Thema Sexualität altersgerecht und geschlechtssensibel zu behandeln.
Bedenklich sei außerdem, dass dadurch das Vertrauen in die Schule generell
zerstört sei: ≥Schule muss ein Raum sein, in dem die SchülerInnen
angstfrei ihre Zeit verbringen können. So ist sie es jedoch nicht", zeigt
sich Kadlec besorgt.
Abschließend verweist die Schülervertreterin auf den Umstand, dass der
Lehrer seine Taten mit der Suche nach Drogen rechtfertigt und stellt
generell klar: ≥Die Überwachung von Menschen ist niemals zu ihrem Schutz,
sondern immer zu deren Kontrolle."

What a week it has been. And it's only Thursday!
On Sunday I had my first real taste of what death penalty defense lawyers
have to go through. I had to tell Billy Kelley that the order granting him
a new trial almost two years ago was reversed by the 11th circuit in a
ruling released late in the day on Friday.
He was in such a good mood throughout our visit - it seemed like the whole
visiting room was joyous, it broke my heart. And everyone in the visiting
room was more joyous than usual. A memo circulated July 21 had served
notice that fans would be made available for purchase and use by prisoners
in their cells, and hobby crafts would again be permitted after several
years without them. It would seem like these are small things, but for the
men on death row, these are minor miracles.
Billy didn't know about the decision in his case when I got there on Sunday
morning around 11am. I had purposely arrived later than usual in hopes
that someone else would be visiting him - maybe even his lawyers. As I
later learned, Billy's lawyers, Lawrence Tribe and Jimmy Lohman had tried
to reach him but the prison would not let the calls go through on Friday -
they had to wait until Monday. If only I had known....
I hated to be the one to tell him, but it was on the Associated Press wire
on Friday night, meaning that it could have been in any Florida newspaper
on Saturday or Sunday. Anyone in that room could have known, and I was
afraid someone else in the visiting room might say something, or worse,
that he would read it in a newspaper or that a guard might have seen the
item and said something. I waited until after Billy had eaten well - the
visiting room features vending machines and microwave ovens to heat up
sandwiches, etc. When there was still a good hour left to talk things
over, and after asking him some questions that helped me understand he
would be more angry if I didn't tell him, I broke it to him.
Billy was in shock. I had to repeat myself. A few minutes later he
described seeing me as being very distant - almost removed, "far away," as
he put it - as he listened to me telling him. As the reality set in, I
could see the hope and the spirit drain from his eyes.
Billy has been on the row for 22 years, and September will be two years
since his conviction was set aside and a new trial ordered. This man is
innocent, and he should have been freed long ago. And he was ready. Now
he has been sentenced to death. He started counting his days, guessing he
has six months. It's probably quite a bit longer before he might have a
death warrant signed. At 62 years of age, he is not interested in a
commutation - even if such were in the offing. After about 20 minutes, he
said "I've got a lot of letters to write," and "I really need a cigarette,"
and he ended the visit. We walked together to the guard desk, and I told
him to hang in there. I watched as he walked back toward the door they go
through. He had to reach out to balance himself. I told the guard what
was up and asked him to check on Billy. It was very sad.
I wish the lawyers had been able to reach Billy. I hadn't planned to visit
that day, but I did want to check out rumors of improvements in the heat
situation - see below for more on that. Learning about the ruling against
Billy left me with no choice but to go. I wanted him to hear it from a
friend he could look in the eye if he hadn't heard it already. I wanted
him to have a chance to talk about it with someone face to face.
I'm left with renewed admiration for those who defend the condemned. As
difficult as it was for me, I can't imagine what lawyers go through when
they have to tell a client that their efforts have failed. The experience
haunts me..... We'll see what happens. There is still hope in a
reconsideration by the full panel of the 11th circuit, and who knows what
else? After all, I'm not a lawyer....

Here's another Billy Kelley story. In June I received a letter from
Billy. In part, he wrote:
"Already it has been brutal in here for the past 10 days, temperatures
ranging from 95 to 99 (with no air flow). We are already standing in the
f-ing toilets pouring "cold" water over our bodies, laying on the cement
floor with water on it, wrapping wet sheets around us, putting our feet in
the toilet and wet towels on our backs, getting dizzy, can't think
clearly. It's f-ing insanity.... If you can get the heat in your bathroom
to 98 degrees and spend the night in there, you'll see how brutal it
is.... The degrading way we have to use the f-ing toilet to try to bring
down the body temperature....
Billy was asking us to start a letter-writing campaign to the Governor. I
called Hannah Floyd of the Florida Death Row Advocacy Group (FDRAG) and
asked her what she thought we should do, and at the same time I invited
participation in brainstorming for ideas - I did that in an e-mail sent to
FADPUpdate and several Floridians for Alternatives to the Death Penalty
(FADP) leadership groups. Those of you on FADPUpdate would have received
that message.
Hannah told me what has NOT worked for the past five years, which is
e-mails, letters, phone calls, etc. Together we hatched a plan, which was
based around the goal of providing actual, tangible relief in the form of a
fan for each prisoner. I told Hannah about Lois Robison and the HOPE of
CURE project in Texas, which is putting fans into prisons in Texas. Hannah
spoke with Lois to learn about the fans they are using, and then with the
manufacturer, which sent us a sample fan and a letter explaining what
prisons in what states are already using the fans.
It is that sample fan that we took to show the Governor. Bush was having
another "Open Office Hours." This was on July 15. It's a longer story
that space allows here, but suffice to say that they saw us coming (see
press release at http://www.fadp.org/pressrel.html ) and jerked us around -
we ended up seeing the Lt. Governor. You can see a picture of that meeting

We were quite disappointed in how we had been treated, but on our way home
we decided to try to see Department of Corrections Secretary James
Crosby. This was a long-shot. The Florida Catholic Conference had been
trying to schedule a meeting on this issue and couldn't get past the
gatekeeper - Crosby's Secretary. As luck would have it, that day the usual
secretary was not in, and her replacement heard me when I bluffed: "We
just met with the Lt. Governor and she says we should meet with Mr.
Crosby. We're on our way through Tallahassee, can we stop by?" She called
us back. We scheduled for 11:30am, and due to traffic, etc. we arrived at
11:50am. Crosby had a 12pm appointment, but "we only need a few minutes,"
we said. Crosby gave us 30 minutes, making his 12pm appointment wait 20
minutes. We left the sample fan with him, with a promise to follow up the
next week.
When we went back to see Crosby on Tuesday, we learned that he had already
moved to approve the sale of fans to prisoners, and he gave us a copy of
the memo that had been distributed on July 21. We negotiated to allow
FDRAG to make the immediate, one-time donation. The only change is that
they decided on a slightly less expensive fan available through the vendor
that the DOC already works with. The fan they ordered is about 65% of the
size of the fan that we proposed. They showed us a sample and we tested it
and found that it will do just fine.
Yesterday afternoon, I received a phone call from the person we are working
with at the DOC - two levels down from Crosby. He informed me that the
fans have been ordered, will ship from the company today (Thursday), and
will arrive at the DOC distribution center on Tuesday by the end of the
day. We expect the fans to be in prisoner's cells by Wednesday or Thursday
at the latest. We will continue to monitor the situation. Crosby's orders
to the wardens and their supervisors is to make this happen as quickly as
possible. We have it in writing. And we will follow up on it.
On Tuesday afternoon after our meeting with Crosby, I sent the following

(another) Miracle on Death RowDear Friends,
In case you were not aware, there is NO air conditioning on Florida's death
row. When it is hot outside, it is hotter inside. Several years ago,
prisoners sued the state, seeking relief of some sort. The lawsuit was
lost, but lawyers from the Florida Justice Institute have appealed, and the
11th circuit court of appeals has yet to rule. Many groups and individuals
have been working hard for years to achieve some sort of relief for the
prisoners.
In May, 2004 Floridians for Alternatives to the Death Penalty (FADP), the
Florida Death Row Advocacy Group (FDRAG), and other prisoner advocates and
prisoner family members began to receive letters from the prisoners again,
imploring us to write to Governor Bush to ask him to do something. But we
knew that we had to be a step ahead of that. We can't write to complain
without being able to offer a solution.
Cutting to the chase, working together with the Florida Catholic Conference
and other movement leaders in Florida, FADP and FDRAG put a strategic plan
into action. After finding a suitable fan in use by prisoners in other
states, meeting with Lt. Governor Toni Jennings and then Secretary of the
Department of Corrections James Crosby on July 15, 2004, on July 21, 2004 a
memo was circulated to the prisons ordering that fans would be made
available for purchase by the prisoners. (Just as an aside, that memo also
announced the return of access to hobby crafts after such items were banned
several years ago.)
When Hannah and I visited Secretary Crosby this morning to follow up on the
heat issue, the Secretary welcomed us into his office by saying, "Well, I
have some good news for you." He told us the prisoners could now buy
fans. After some discussion, Secretary Crosby agreed to allow FDRAG to
donate a fan to every death row prisoner, and to make it happen
immediately. Secretary Crosby ordered his assistants into action. FADP
and FDRAG wish to publicly thank Secretary Crosby for being open to meeting
with us, and for aggressively working with us to resolve this issue as
quickly as possible. He did not have to do this.
The following memo was today issued to the wardens of the three Florida
prisons housing death row inmates, and to the supervisors of those wardens:
"The Florida Death Row Advocacy Group (FDRAG) has been approved by
Secretary Crosby to make a one time donation of 400 fans to death row
inmates. You are to facilitate this donation as efficiently as
possible. The Bureau of Institutional Support is arranging the donation
through the Corrections Foundation and the Access Catalogue. Information

HOSTING A VIEWING PARTY FOR DEADLINE
The good people at Bigmouth Productions are working extra-hard to ensure a
high viewership of their program, "DEADLINE," which will air on NBC NEXT
FRIDAY.

I'd like to ask your help with informing people about our upcoming
documentary's broadcast and coinciding Viewing Parties.
Deadline, which follows former Governor of Illinois George Ryan's
decision to grant clemency to 167 death row inmates, is due to air on
NBC's Dateline, July 30th. The film premiered at The 2004 Sundance Film
Festival and has been screening at other festivals and theaters in the
US and Europe. We are in the midst of a huge outreach campaign which
includes setting up Viewing Parties (a la MoveOn.org) across the
country.
One of our goals for The Viewing Parties is to have at least one party
in each state with the death penalty. We would love if your
organization could help us mobilize people by posting information about
our broadcast and Viewing Parties on your website or sending out an
email to your co-workers, friends and/or personal or organization's
mailing list or newsletter.

How to Host a Deadline Viewing Party
Can capital punishment be upheld in a criminal justice system so
fraught with error that in Illinois 13 of the 25 inmates slated for
execution were discovered to be innocent?
That was the question that former Illinois Governor George Ryan faced
in the final days in office last year as he decided whether to let 167
people live or die. And it is the question that America will face on
Friday, July 30th when DEADLINE, a riveting new documentary, has its
national television premiere in a special two-hour edition of NBCs
Dateline at 8pm (Eastern Standard Time).
It is unprecedented for a film like DEADLINE to be able to reach such a
large, diverse audience. It is important for viewers to tune in to show
the network just how hungry the American public is for media that forces
us to question and to think.
We are asking people across the country to host a Viewing Party the
night of the broadcast (July 30th at 8pm EST) for their friends, family
and community members. These Viewing Parties can be a powerful way to
spread the word and promote national discussions of America's criminal
justice system and the death penalty.
Hosting a DEADLINE Viewing Party is easy. You will:
